请教一个关于明示条文和默示条文的问题

在有了《海牙规则》后，是不是船东就不能在合约中以明示条文来规定“船舶可以不适航”？是不是即使这样规定也无效？谢谢！

At the Hague-Visby rules, carrier's obligation is due diligence to ship seaworthiness. The provision is a mandatory. A contrary clause at the sea carriage contract cannot prevail it.
