本人并非海商法科班出身，专业国际航运管理，不过对海运和合同范本颇有兴趣和专研。在这里发表一下愚见，出错的地方请包涵和指正。FILO 是free in and liner our,charterer 负责装，船东负责卸。这主要针对费用的划分，但具体的责任和风险还是要看合同怎么约定。eg. 按照GENCON94第52-54行The cargo shall be brought into the holds, loaded, stowed and/or trimmed,  
tallied, lashed and/or secured and taken from the holds and discharged by the  
Charterers, free of any risk, liability and expense whatsoever to the Owners.  很明显合同清楚地规定包括配载，平仓在内的责任和风险都应该是charterer负责，所以在这种情况下贵公司不应该找船东理赔。而应该找根据贵公司和港方的协议协商。
